Daniel specialises in Criminal law. Daniel’s practise regularly sees him defending in the Crown Court, as Leading Junior and Junior alone, on offences such as attempted murder, rape and serious sexual assaults, GBH and violent disorder, immigration offences, drugs conspiracies and offences of dishonesty.
In addition to his Crown Court work, Daniel has a breadth of experience in dealing with cases at the Court of Appeal.
Daniel began his career as a Barrister working as in-house Counsel with a well-established East London Solicitors, regularly representing their clients in all Courts. As a result, he has a unique insight into what is expected of Counsel, by a professional client.

Defence:
R v B (Canterbury) – Defendant alleged to have attempted to murder his wife by stabbing her in the back, without warning. The defence at trial was that the entire incident was accidental, the defendant having tripped over a dog toy in the kitchen after scraping the contents of a chopping board into the bin, then stumbling into the complainant. The case included contested expert pathology evidence. The defendant was unanimously acquitted. The case was covered by local media (https://www.kentonline.co.uk/ashford/news/landlord-cleared-of-attempting-to-murder-wife-in-pub-kitchen-293248/) and was also featured on "X" following an unusual request by the trial Judge for the defendant to demonstrate his evidence with the assistance of the Court Usher.
R v M & Others (Canterbury) – represented a 16 year old youth, charged with the attempted murder of 2 other youths following a pre-arranged fight in a public car park, which resulted in serious knife wounds. The Crown accepted pleas to offences of unlawful wounding after the trial had commenced.
R v P & Others (Snaresbrook) – represented a 16 year old youth charged with attempted murder, alongside 7 other youth defendants, in relation to 2 separate stabbing incidents. Led by Queen’s Counsel.
R v T (Snaresbrook) – represented the defendant, charged with the rape and attempted rape of 2 separate complainants and a sexual assault of a 3rd female. The 2 complainants alleging rape were not known to each other. The defendant was unanimously acquitted.
R v H & Others (Snaresbrook) – Daniel represented one of 7 defendants charged with a conspiracy to supply over a tonne of cannabis resin. The defendant was arrested during the course of loading blocks of resin into his van, having been followed by undercover surveillance. His client was unanimously acquitted after a trial lasting more than 4 months.
R v M & Others (Blackfriars) – represented one of 6 defendants charged with conspiracy to supply class A drugs via a “county line” operating in the Norwich area.
Prosecution:
R v S, K & W (Woolwich) - Leading prosecution counsel. Defendants charged in relation to a firearm recovered by police at the address of family members of one defendant. Surveillance evidence showed a transfer of an article between them and messages recovered tended to suggest references to a firearm. The defendants pleaded guilty to possession of the firearm at the close of the Crown’s case following 10 days of evidence.
R v K & ors (Kingston) - Leading prosecution counsel. Defendants charged with kidnap and GBH, following a dispute arising out of the complainant's brother being suspected of involvement in a burglary of the second defendant's student accommodation. The first and second defendants were convicted of GBH assaults following a trial lasting almost 8 weeks.
R v A (Snaresbrook) - Defendant was charged with possession of a firearm and possession of ammunition, namely a CZ52 self-loading pistol and 9mm bullets for use with the same weapon. His defence at trial was that he had confiscated the weapon from terrorist organisations and that he would have handed it to police. He was convicted after a 6 day trial.

R v T (Snaresbrook) - The defendant was charged with Rape and Attempted Rape. Allegations were made by 2 unrelated complainants following meeting the defendant during the course of his employment as a bus driver. A third complainant made an allegation of sexual assault. The defendant maintained that all sexual activity with the complainants was consensual. The defendant was unanimously acquitted despite the Crown's reliance on a significant degree of similarity between the allegations made.
R v F – (Winchester) - Successfully defended the defendant from allegations of possession of controlled drugs with intent to supply, following a search of his home address. The defendant relied on the s.45 "modern slavery" defence.
R v R & Others (Central Criminal Court) – represented one of 8 defendants, charged with assisting unlawful immigration, during a 6 week trial. The matter was prosecuted by Queen’s Counsel. This defendant was one of only two defendants to receive a suspended sentence after trial.
R v T & Others (Snaresbrook) – represented one of 4 defendants charged with conspiracy to supply heroin, following a surveillance operation.
R v V (Central Criminal Court) – secured the acquittal of the defendant, a city lawyer, charged with possession of indecent images. The defence at trial focussed on the defendant’s involvement in the “chem-sex” scene and attracted media attention. Following a 5 day trial, the defendant was unanimously acquitted after approximately 3 hours’ deliberations.
R v C & another (Snaresbrook) – secured the acquittal of the defendant, charged with violent disorder, following a fight in a street which resulted in the main complainant suffering significant wounds to his head from a machete.
R v L (Snaresbrook) – represented a defendant charged with GBH, following an altercation with his sister. The defendant was acquitted at trial on the basis of lawful self-defence. A feature of the defence case relied upon the complainant’s previous mental health issues.
R v C (Snaresbrook) – represented defendant successfully at trial following allegations of child abuse against his autistic son.
R v P (Snaresbrook) – represented the defendant, charged with rape. The Crown sought to introduce bad character evidence, including matters for which no prosecution was initially mounted. Daniel was able to persuade the Prosecution to offer no evidence as a result of material found on the defendant’s phone, following repeated applications for further disclosure.
Fraud and Financial Crime:

(Kingston) – prosecuted
a case involving fraudulent manipulation of customer accounts by a Santander employee. The matter was followed by the media for The Acused, a documentary about the trial process.

Daniel Cohen successfully appealed to the Court of Appeal against his client's sentence for assault by penetration. The sentence was found to be manifestly excessive and accordingly, was reduced by 18 months.
Daniel Cohen successfully represented a defendant who was charged with the kidnap of his partner at Maidstone Crown Court.
