Defence Police Station Representation and Pre-Charge Advice

Where a person is being investigated by the police, they may wish to consider seeking expert legal advice and representation from specialist criminal defence solicitors and/or a barrister. Either professional can explain the whole pre-charge procedure and advise a client on their position, any steps to be taken and the likelihood of any charge.

Police Station Representation (PSR)

A police station representative can provide legal advice and support, from a very early stage, where a person has been arrested or taken to a police station. Once instructed, the representative can then provide legal advice regarding their rights and the legal process.

Here at 9 KBW we are fortunate in having very experienced Counsel who are also Accredited Police Station Representatives. Several have previously qualified as Solicitors, and later transferred to the Bar and  have many years of experience in representing clients, from the initial stage of arrest and who are accused of criminal offences.

Members of Chambers, who are qualified to undertake police station representation, can either be instructed through a solicitor, or under the Direct Public Access scheme,

A PSR will fully explain what the charges are, or are likely to be, and the choices that the client has going forward, as well as explaining the position regarding any restraint or bail conditions.

The representative will take steps to ensure that their client is fully aware of and understands their rights, including the right to remain silent, the right to legal representation and the funding options for that representation.

A PSR will attend any police station interviews with their client, to both observe the questioning and to ensure that there is strict adherence to the rules governing police procedures when conducting the interviews. The representative may also be asked to advise their client at any given point during an interview and, where necessary, intervene if they believe that the interview is not being conducted fairly and in accordance with legislative procedures.
