Sam March client acquitted after trial under Dangerous Dogs Act

Instructed by Scarlett Watkins of Carson Kaye solicitors, Samuel March represented a client
who was acquitted after trial of being in charge of a dog who was dangerously out of
control.
The Defendant lived with his mother. He had implemented a system of safety gates in her
home to ensure his dog was secured when the front door was opened. His mother – despite
repeated reminders - failed to adhere to this system, allowing the dog to escape and bite
another dog.
Sam successfully argued that there was no act or omission by the Defendant himself that to
a more than minimal degree caused or permitted the incident to happen.
Both Sam and Scarlett also worked pro bono to secure the release of one of the Defendant's
other dogs, who police were refusing to release despite her not having been involved in any
way. Police ultimately released the dog after a Police Property Act application was made.
