This has been published in Archbold 2016 (paragraph 32-30). The case concerns the new offence of Causing Serious Injury by Dangerous Driving for which there are no sentencing guidelines. The issue was whether the Learned Recorder sentencing Mr. Buckle was correct to use a starting point of the statutory maximum for the offence as this was not a ‘near death’ case. The Court of Appeal found that in where there was an accumulation of aggravating factors such a starting point was justified.”
