The successful appeal was against the decision of the SSHD who refused to revoke a deportation order made in the early 1990s. The Appellant re-entered the UK in 2006 in breach of the deportation order and remained in the UK since. The Appellant suffered with serious heart problems and despite providing detailed medical evidence the SSHD refused to revoke the deportation order. The FTTJ was satisfied that on the basis of the evidence and submissions the Appellant would suffer a significant reduction in life expectancy such that the test in AM Zimbabwe [2020] UKSC 17 was met.
